THE TERMS OF USING FITR

Terms of service.

This is the permanent home for the terms that govern using Fitr.

Last updated: October 19, 2026

1. About these terms

These terms cover the Fitr website, app, and related services operated by Fitr Technologies Inc., an Alberta corporation with its registered office at 2100 – 222 3 Avenue SW, Calgary, Alberta T2P 0B4. Contact support@fitr.ca for service questions and legal@fitr.ca for legal or rights-holder enquiries.

When published as effective terms, they apply together with feature-specific terms presented to you. Separate creator, brand, retailer, or payment agreements apply to the matters they cover. The Privacy Policy explains information handling; agreeing to these terms is not a substitute for any separate consent required by law.

2. Eligibility and accounts

You must be at least 14 to use Fitr and satisfy applicable local age and consent requirements. If parental or guardian authorization is required where you live, it must be obtained before use.

Provide accurate account information, protect your credentials, and tell us about suspected unauthorized access. You are responsible for activity you authorize through your account. Public browsing may be available as a guest; personalized features may require an account. Do not impersonate someone or claim a brand or store without authority.

3. Features and availability

Fitr provides fashion discovery, social features, wardrobe organization, styling tools, and supported shopping and creator features. Availability can vary by location, device, version, eligibility, provider, and retailer. Features may change or be discontinued, subject to applicable law and paid-service commitments.

Website product previews are interactive illustrations. They do not create a real wardrobe, connect to a live stylist, make a purchase, or reserve a product. Store buttons marked coming soon do not indicate that a public download is available.

4. Early access and email choices

Joining the waitlist is free. It does not create an app account, start a paid subscription, guarantee an invitation, or promise a launch date. By selecting the email-consent box and submitting the form, you request Fitr early-access and launch emails. Unsubscribe through an email link or contact support.

Do not submit another person’s email without authorization. Separate consent may be required for other marketing. The Privacy Policy describes subscriber storage, email-provider processing, and your choices.

5. Your content and permissions

You retain ownership of the content you submit, subject to others’ rights. You grant Fitr a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, distribute, and technically process it as necessary to provide the service features you use, including through service providers and to the recipients and audiences you choose.

This licence is limited to operating those features and does not transfer ownership or grant an unrestricted right to use your content in unrelated advertising. It continues only as necessary for those purposes and the retention described in the Privacy Policy. You must have the rights and permissions needed for uploads and information about other people. Removing content cannot retract independent copies already made by others. If you import posts from Instagram or your camera roll, you confirm you have the right to publish them on Fitr, including any people who appear in them.

6. Acceptable use

Use Fitr lawfully and respectfully. Do not:

  • Harass, threaten, exploit, impersonate, or disclose someone’s private information without permission.
  • Post illegal content, child sexual exploitation material, non-consensual intimate imagery, fraudulent offers, or material that infringes another person’s rights.
  • Send spam, manipulate engagement, misrepresent commercial relationships, or automate abusive signup or messaging activity.
  • Bypass access restrictions, compromise security, distribute malicious software, harvest personal information without authorization, or interfere with the service.

7. Reports, moderation, and rights-holder requests

We may review reported activity, remove or limit content, restrict features, or suspend or terminate accounts where reasonably necessary to address violations, fraud, safety, or legal obligations. We will provide notice and a contact path where appropriate and required by law; serious risks may require immediate action.

Use in-app reporting and blocking tools or email support@fitr.ca. For copyright or other rights-holder concerns, send legal@fitr.ca your contact details, the material and its location, the right claimed, and enough information to evaluate the request. Do not submit knowingly false reports. Contact us if you believe an enforcement decision was mistaken.

8. AI and styling suggestions

AI outputs are suggestions and may contain mistakes or omit context. Review outfits, receipt details, product matches, and other results before relying on them. Fitr does not guarantee product availability, fit, colour accuracy, or suitability for a particular event. Style DNA, ERA, and photo styling are not medical or identity assessments.

AI features process the inputs and context described in the Privacy Policy through configured providers. Do not submit material you lack permission to use. Ownership and permitted use of output remain subject to applicable law and third-party rights.

9. Products, retailers, and payments

Listings, prices, stock, store details, and promotions may come from third parties and can change. Check the retailer’s current information before purchasing. Retailer links lead to separate services with their own purchase, privacy, fulfilment, and return rules.

Where in-app checkout is supported, review the identified seller, price, taxes, delivery information, and purchase conditions in that flow. The payment provider identified at checkout processes payment. These terms do not replace a specific purchase contract or remove statutory consumer rights. Any paid plan offered through Fitr must disclose its price, billing interval, and cancellation terms before purchase.

10. Creators, affiliates, and brand tools

Creator commissions and brand partnerships are not yet open. When they open, their rates, attribution windows, payout schedule, and tax treatment will be set out in separate program terms you will accept before joining. A tag, click, or post does not itself create a right to payment.

Creators and brands are responsible for accurate claims and required disclosures of paid, gifted, or affiliate relationships. Unofficial catalogue inclusion is not an endorsement or proof that a brand authorized an account. Contact us to claim, correct, or challenge a listing.

11. Fitr’s intellectual property

Fitr’s software, branding, interface, and service materials are protected by applicable intellectual-property laws. You may use the service personally and use business tools as authorized. These terms do not grant ownership of Fitr’s trademarks, code, or other users’ content, or authorize resale or copying beyond applicable law and the permissions provided.

On iOS, these terms are between you and Fitr only, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

12. Ending use and deleting an account

You may stop using Fitr at any time. Account deletion is available in the app, with email assistance if you cannot access it. Uninstalling does not delete an account. The Privacy Policy describes deletion and retention. Waitlist preferences are separate from app-account deletion.

Ending access does not cancel obligations already incurred under a purchase or separate program agreement. Provisions that reasonably need to continue, including ownership, accrued obligations, and dispute provisions, continue where lawful.

13. Availability and responsibility

To the extent permitted by law, the service is provided as available without a promise of uninterrupted or error-free operation, particular results, or accuracy of third-party or AI-generated content. Fitr remains responsible for exercising the care required by applicable law.

To the extent permitted by law, Fitr is not liable for indirect or consequential losses, lost profits, or losses caused by independent third parties outside its reasonable control. This does not exclude liability or warranties that cannot lawfully be excluded, including mandatory consumer protections or liability for fraud or intentional misconduct.

14. Governing law and disputes

Subject to mandatory rights in your place of residence, these terms are governed by Alberta law and applicable federal Canadian law. Contact legal@fitr.ca so we can try to resolve a concern. Nothing here requires arbitration, waives a lawful complaint, or removes a court or consumer remedy guaranteed by applicable law.

15. Updates and contact

We may revise these terms as the service changes. Material changes will be communicated as required, and any legally required acceptance will be obtained. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Send questions to legal@fitr.ca.
